Gift Card Terms & Conditions
the value of the gift card may be redeemed towards a portrait session and prints photographjed my Samantha Kuruvita. Appointments are essential and may be reserved by calling 0418 780 009. This giftcard is to be treated like cash and cannot be replaced if lost or stolen. Only one gift card be presented and it is not valid in conjunction with any other offers or redeemable for cash
General Terms & Conditions
We understand and agree that:
THE CLIENT
We retain the Studio as the sole photographer to perform professional photographic service as detailed.
We have received, read and understand the Studio’s price list.
We assign the copyright in all photographs to the Studio and hereby give permission to the Studio to use any images from the session for advertising, publicity, general promotion, competitions, exhibitions and any other purposes thought proper by the Studio.
It is understood that these photographs are only to be used as agreed and may not be copied or reproduced unless written approval has been granted by the Studio.
The negatives/files remain the property of the Studio and will be kept in storage for a period of at least five years. We recognise that materials and technology change constantly so we need to place our required order as soon as possible to obtain the optimum quality. We also accept that charges for our orders will be at the current prices applying at the time when the order is placed.
The optional booking fee is payable before the photography session and results in an additional $100 credit that can be used in conjunction with any other offer that is being offered at the time. The booking fee is non-refundable but can remain on your file as a credit indefinitely. The additional $100 credit is only available for the session that it was originally offered for and will be forfeited if not used to purchase images from that original session.
We understand that if we are unable to make a decision at the viewing session, an additional viewing session or an online gallery may be arranged at a cost of $150.00. Online gallery is available for a period of 7 days after which an additional $50 per fortnight payable in advance will apply.
We also understand that :
(a) All orders must be accompanied by a 50% deposit unless otherwise agreed.
(b) The goods supplied by the Studio shall remain the property of the Studio until full payment has been made.
(c) Telephone orders require payment by credit card before the order can be produced.
(d) All freight and postage which we request will be paid by us.
(e) All retouching which we request will be paid by us.
(f) The Studio has no control over the environment in which the photos are kept and that colour photographs, in common with all sensitized materials and colour dyes, have a limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources. Photographs will retain their colour and brilliance much longer when displayed under more desirable lighting conditions.
(g) Should we fail to pay and collect the photography order within fourteen days of notification of completion, the order shall be in default and the Studio shall apply a default charge of 1.5% per month (18% annual rate) on the unpaid balance (minimum monthly charge of $5.00). THE STUDIO
As the photographs made by the Studio are manufactured with the finest materials currently available, the Studio unconditionally guarantees them. If in your opinion any photograph made by the Studio has lost its original colour under normal conditions, the Studio will replace the photograph for 50% of the current selling price. The original photograph must be returned and the reprinting charge paid in advance. This warranty will be valid for as long as the Studio has in its possession the original negative/files in a printable condition.
The Studio shall carry out this assignment with due and professional diligence however there are elements beyond the Studio’s control including faulty material, equipment failure, damaged and exposed film, loss of film/photos/negatives/files in transit between the Studio and laboratories employed by the Studio, loss or damage to film, negatives/files and proofs during processing and developing, either by the Studio or laboratories employed by the Studio, industrial disputes, civil disturbances or weather conditions which may inhibit or prevent the Studio from completing in whole or in part and the Studio shall not be liable for the complete performance of the assignment and it is agreed that the liability of the Studio shall be limited to a refund of any money paid under this agreement which shall be

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our website www.samanthakuruvita.com.au, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:
• For the primary purpose for which it was obtained
• For a secondary purpose that is directly related to the primary purpose
• With your consent; or where required or authorised by law.
Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Disclosure of Personal Information
Your Personal Information may be disclosed in a number of circumstances including the following:
• Third parties where you consent to the use or disclosure; and
• Where required or authorised by law.
Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
Access to your Personal Information
You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
Images by Samantha Kuruvita will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.
Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
